On Tuesday, December 12, the National Super Alliance (NASA) will swear in Raila Odinga as the people’s president.
The Attorney General now says the Jamhuri Day-scheduled event would be treasonable which is punishable by death as it seeks to form a parallel government.
“The punishment of committing treason is death. The swearing-in of any person not declared by IEBC, and who did not win the election, is unacceptable,” the chief government legal officer said in a press on Thursday, December 7.
Prof Muigai went on to add that if an inauguration is not overseen by Chief Justice David Maraga is null, void and illegal.
“The criminal law of the Republic of Kenya stipulates that this sort of process is high treason. It is high treason of the persons involved and any other person facilitating that process,” he noted.
The government had already cautioned that Opposition leaders will be punished if they went on with their plans.
Article 3(2) of the constitution obligates everyone to uphold and respect it. Subsection 2 says that any attempt to establish a government otherwise than in the compliance with this constitution is unlawful.
